1. Acceptance of terms

By accessing or using Subby ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of the Service

Subby is a web-based platform that allows users to create subscriber signup forms and collect email addresses from their audience. The Service is currently in pre-launch; access is provided on a waitlist basis.

3. Waitlist

By submitting your name and email address to the Subby waitlist, you express interest in using the Service upon its launch. Joining the waitlist does not guarantee access to the Service, nor does it create any contractual obligation on our part to launch by a specific date.

4. Acceptable use

You agree not to use the Service to:

  • collect personal data without the knowledge or consent of the individuals concerned;
  • send unsolicited communications (spam) to subscribers;
  • violate any applicable local, national, or international law or regulation;
  • infringe the intellectual property rights of any third party;
  • transmit any material that is harmful, offensive, obscene, or otherwise objectionable;
  • attempt to gain unauthorised access to any part of the Service or its infrastructure.

5. Intellectual property

All content, design, code, and materials comprising the Service are the property of Subby and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

You retain full ownership of any subscriber data you collect through forms you create using the Service.

6. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described therein.

7. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of liability

To the fullest extent permitted by law, Subby shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount paid by you to us in the twelve months preceding the claim.

9. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We may also revise these Terms at any time by posting the updated version on this page with a new effective date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

10. Governing law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.
